NOTICE IS HEREBY GIVEN, that the Board of City Commissioners of the City of Bismarck, North Dakota, will receive sealed bids at the Office of the City Administrator until Tuesday, March 6, 2018 at the hour of 3:00 p.m. local time, for the purpose of furnishing all materials, labor, equipment, and skill required for the Bismarck Water Treatment Plant FILTER MEDIA REPLACEMENT, and incidental items as described in the contract documents which are now on file with the Public Works Utility Department.  Bids will be publicly opened and reviewed at 4:00 p.m. CDT March 6, 2018 at the First Floor Conference Room, City/County Building, 221 North 5th Street, Bismarck, ND. 

The work consists of all labor, skill, and materials required to properly provide improvements to the 14 gravity filters generally described as: 

One (1) Contract – All Construction (lump sum): 

Removal, hauling, and disposal of all existing anthracite and sand media.  Purchasing, shipping, storing, placement, cleaning, and disinfection of new media.  The media consists of approximately 247 cubic yards of sand and 461 cubic yards of anthracite.  Instructions, replacement, and details are provided in the bidding documents.

Qualifications:
All bidders must be licensed for the highest amount of their bid, as provided by Section 43-07-05 of the North Dakota Century Code. Cost of preparation of bids is by bidder. Contracts shall be awarded on the basis of the low bid submitted by a responsible and responsive bidder deemed most favorable to the City’s interest.

Special Requirements:
All bids shall be contained in a sealed envelope plainly marked showing that such envelope contains a bid for the project. In addition, the bidder shall place upon the exterior of such envelope the following information:

1. BID for “Project Name.”
2. The name of the bidder.
3. Acknowledgement of all Addenda _____ through _____.
4. Separate envelope containing bid bond, a copy of contractor’s license or renewal certificate, and any additional materials identified in the instructions to bidders.

Bids shall be delivered to: Office of City Administrator, City/County Building, 221 North 5th Street, Bismarck, ND, or mailed to: Office of City Administrator, PO Box 5503, Bismarck, ND 58506-5503. Bidder shall assume all risk for timing of delivery method.

Miscellaneous:
The City reserves the right to reject any and all bids, to waive any informality in any bid, to hold all bids for a period not to exceed thirty-one (31) days from the date of opening bids, and to accept the bid deemed most favorable to the interest of the City. After the bid opening, the owner will return bid security of all except the three lowest responsible bidders. When a contract is awarded, the remaining unsuccessful bidders’ bonds will be returned.

The work on all improvements shall be completed and ready for final payment no later than July 31, 2018, with a May 11, 2018 milestone set forth in the bidding documents. Should the contractor fail to complete the work within the time required, as set forth in the agreement, or within such extra time as may have been granted by formal extensions of time approved by the City and engineer, there shall be deducted from any amount due him the sum of $500.00 per day as compensation to the City for each day and every day that the completion of the milestone, substantial, and final work is delayed. The contractor and his surety shall be liable for any excess. Such payment shall be as and for liquidated damages and not as a penalty.
