BISMARCK WATER TREATMENT PLANT
HIGH LIFT PUMP NO. 5 REPLACEMENT &
City of Bismarck (Owner) is requesting Bids for the construction of the following Project:
CITY OF BISMARCK, ND WATER TREATMENT PLANT
HDR Project Number: 10263887
Bids for the construction of the Project will be received at the Board of City Commissioners, of the City of Bismarck, in the Offices of the City Administrator, until 3:00 p.m., Monday, October 18th, 2021. All bids will be submitted to the City Administrator (PO Box 5503, Bismarck, ND 58506-5503) or otherwise deposited with the City Administrator (221 North 5th Street, Bismarck, ND 58501) and shall be sealed and endorsed “Bismarck Water Treatment Plant High Lift Pump No. 5 Replacement & Electrical Improvements Project”. If a bid is to be faxed, the bid must be sent to a bidder’s agent independent of the City of Bismarck, placed in a sealed envelope, labeled according to this specification, and delivered to the office of the City Administrator prior to the bid deadline.
Bids will be publicly opened and reviewed at 4:00 p.m. on Monday, October 18th, 2021 at the Mayor’s Conference Room, 4th Floor, at 221 North 5th St., Bismarck, North Dakota. At that time the Bids received will be publicly, as applicable to the Project, opened and read.
Notes to User—The Advertisement may be for a single prime contract, or for multiple prime contracts being bid concurrently. For a single prime contract, delete the “[Or],” the wording that introduces the table, and the table itself. For multiple contracts, delete the sentence beginning “Bids are requested for the following…” and the “[Or”], and retain the table and introductory wording. Obtaining the Bidding Documents
Guidance Notes—Bidding Documents may be made available to prospective Bidders using a variety of methods ranging from providing printed documents to allowing them to be downloaded from a website. If the Bidding Documents will be made available in an electronic format, then the following standard paragraphs assume that the documents will be distributed as PDF files. If other types of files, such as native CAD files or building information models (BIM), will be made available to prospective Bidders, then edit the Advertisement accordingly, and review Guidance Note 9 accompanying Article 2 of the Instructions to Bidders for Construction Contract (2018), and the provisions of EJCDC® C-001, Commentary on 2018 Construction Series (2018), regarding file formats other than PDFs.

Prospective Bidders are urged to register with the designated website as a Bidding Documents holder, even if Bidding Documents are obtained from a third-party plan room or source other than the designated website in either electronic or paper format. The designated website will be updated periodically with Addenda, lists of registered Bidding Documents holders, reports on the Site, and other information relevant to submitting a Bid for the Project. All official notifications, Addenda, and other Bidding Documents will be offered only through the designated website. Neither Owner nor Engineer will be responsible for Bidding Documents, including Addenda, if any, obtained from sources other than the designated website.

The Issuing Office for the Bidding Documents is:

Prospective Bidders may obtain or examine the Bidding Documents at the Issuing Office on Monday through Friday between the hours of 8:00 a.m. to 4:30 p.m. local time and may obtain copies of the Bidding Documents from the Issuing Office as described below. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda, if any, obtained from sources other than the Issuing Office.
Notes to User—Owner should determine if it is desirable to require attendance (mandatory) at the pre-bid conference. Coordinate with the Instructions to Bidders. Choose the appropriate following paragraph and delete the paragraph not used.
A pre-bid conference for the Project will be held on September 30th, at 2:00 p.m. at the Bismarck WTP, 615 River Road, Bismarck, ND 58504. Attendance at the pre-bid conference is encouraged but not required.
Bidder shall place a completed bid in an opaque sealed envelope as detailed in Section 00 21 13 Instructions to Bidders; Article 14 and summarized as follows:1. Opaque sealed envelope (Bid Envelope) shall be plainly marked "BID FOR Bismarck Water Treatment Plant High Lift Pump No. 5 Replacement & Electrical Improvements Project"2. Opaque sealed envelope (Bid Envelope) shall be addressed to City Administrator at the delivery address indicated below.3. Clearly mark the name and address of bidder on the outside of the opaque sealed envelope.4. The Completed Bid Form (00 41 13) shall be placed in the opaque sealed envelope (Bid Envelope).5. Include "Acknowledgement of Receipt of Addenda ____________________ through ______________” on the outside of the opaque envelope.6. The bidder shall attach a separate sealed envelope labeled "Bid Security Envelope” to the outside of the opaque sealed envelope. The bidder shall include "Bid Bond" and "Contractor's License or Certificate of Renewal" information within this sealed envelope.7. The Bidders Qualification Forms (00 45 13) shall be provided after submittal of the bid, if requested, within 5 working days of Owner’s or Engineer’s request.Bids shall be delivered or mailed to:

All Bidders shall have a valid North Dakota Contractor's license of the appropriate Class for the work as required by Section 43-07-05 (NDCC). Bidders shall enclose a copy of their license or Certificate of Renewal in the same envelope as the Bidders Bond, as required under 43-Q7-12 (NDCC). No Bid will be read or considered unless it fully complies with the Bond and license requirements. Any deficient Bid will be resealed and returned to the Bidder.
Bidders on this work will be required to comply with the President’s Executive Order No. 11246, as amended. The requirements for bidders and contractors under this order are explained in the specifications.
The Work shall be completed and ready for Final Payment no later than April 29th, 2022 with interim milestone dates as indicated in the bid documents. Should the Contractor fail to complete the Work within the time required, as set forth in the Agreement, or within such extra time as may have been granted by formal extensions approved by the City and Engineer, there shall be deducted from any amount due him the sum of $500.00 per day as compensation to the City for each day and every day that the completion of the Work is delayed. The Contractor and his surety shall be liable for any excess. Such payment shall be for liquidated damages and not as a penalty. Refer to Section 106, Paragraph 2, of the Construction Specifications for Municipal Public Works Improvements for additional information.
