[ARCHIVED] Public Hearing Notice

Notice is hereby given that the Bismarck Planning & Zoning Commission will hold public hearings on Wednesday, September 25, 2013, at 5:00 p.m. in the Tom Baker Meeting Room, City-County Building, 221 North 5th Street, Bismarck, North Dakota, to consider the following items:

• Request of Skyline Properties, LLC for approval of a zoning change from the P-Public, RT-Residential, CG-Commercial and MA-Industrial zoning districts to the CG-Commercial and MA-Industrial zoning districts for Meadowlark Commercial 7th Addition. The property is located in north Bismarck, along the east side of US Highway 83 and along the south side of the future section line road, 57th Avenue NE (A replat of Auditor’s Lot C, Lots 1 and 2, Block 3, Meadowlark Commercial Third Addition and LaSalle Avenue and 15th Street North right-of-ways, Section 15, T139N-R80W/Hay Creek Township).

• Request of Skyline Properties, LLC for approval of a final plat for Meadowlark Commercial 7th Addition, a 12 lot subdivision on 58.57 acres. The property is located in north Bismarck, along the east side of US Highway 83 and along the south side of the future section line road, 57th Avenue NE (A replat of Auditor’s Lot C, Lots 1 and 2, Block 3, Meadowlark Commercial Third Addition and LaSalle Avenue and 15th Street North right-of-ways, Section 15, T139N-R80W/Hay Creek Township).

• Request of JL Partnership, Northern Improvement Company and the City of Bismarck for approval of a zoning change from the A - Agricultural & MA – Industrial zoning districts to the MA – Industrial zoning district for East Divide Industrial Park Addition. The property is located in northeast Bismarck, along the south side of East Divide Avenue, directly west of 52nd Street NE (Auditor’s Lots B-B, C-C, D & E of the South ½ of Section 25, T139N-R80W/Hay Creek Township).

• Request of JL Partnership, Northern Improvement Company and the City of Bismarck for approval of a final plat for East Divide Industrial Park Addition, a 21 lot subdivision on 78.05 acres. The property is located in northeast Bismarck, along the south side of East Divide Avenue, directly west of 52nd Street NE (Auditor’s Lots B-B, C-C, D & E of the South ½ of Section 25, T139N-R80W/Hay Creek Township).

• Request of Santa Fe, LLP, Capital Electric Cooperative, Inc. and Chad and Stacy Wachter for approval of a zoning change from the A-Agricultural zoning district to the R5-Residential, R10-Residential, RM30-Residential and P-Public zoning districts on South Meadows Addition. The property is located in southwest Bismarck along the south side of Burleigh Avenue and the west side of South Washington Street (part of the E1/2 of Section 20, T138N-R80W/Lincoln Township).

• Request of Santa Fe, LLP, Capital Electric Cooperative, Inc. and Chad and Stacy Wachter for approval of a final plat for South Meadows Addition, a 149 lot subdivision on 75.89 acres. The property is located in southwest Bismarck along the south side of Burleigh Avenue and the west side of South Washington Street (part of the E1/2 of Section 20, T138N-R80W/Lincoln Township).

• Request of Ken and Jane Wagner and Jamie Feist for approval of a zoning change from the A-Agricultural zoning district to the RR5 – Residential zoning district for Wagner Subdivision. The property is located east of Bismarck along the south side of Apple Creek Road, north of the BNSF Railroad, 1/4 mile east of 66th Street SE (part of the NW 1/4 Section 8, T138N-R79W/Apple Creek Township).

• Request of Ken and Jane Wagner and Jamie Feist for approval of a final plat for Wagner Subdivision, a two (2) lot subdivision on 41.6 acres. The property is located east of Bismarck along the south side of Apple Creek Road, north of the BNSF Railroad, 1/4 mile east of 66th Street SE (part of the NW 1/4 of Section 8, T138N-R79W/Apple Creek Township).

• Request of 12th Street Investments LLC for approval of a zoning change from the MA-Industrial zoning district to the CG-Commercial zoning district on Lots 1-3, Block 1; Lots 1-3, Block 2 & the vacated Mayfair Avenue, Mayfair Managers Addition, and Tract S of the SE 1/4 of Section 4, T138N-R80W. The property is located in south Bismarck along the west side of South 12th Street and the south side of Bismarck Expressway.

• Request of Bismarck Park Avenue Properties, LLP for approval of a special use permit for a drive-through to be located on the West 206 feet of Tract 1503 of the NW 1/4 of Section 3, Lincoln Township (City Lands) (1421 East Main Avenue.)

• Request of the City of Bismarck for approval of a zoning ordinance text amendment to Section 14-09-04 of the Bismarck Code of Ordinances relating to Subdivision Regulation/Recording of Documents. The proposed amendment would require the recording of home owners’ association documents with final plats where there are lots with common ownership.

• Request of the City of Bismarck for approval of a zoning ordinance text amendment to Section 14-09-03 of the Bismarck Code of Ordinances relating to Subdivision Regulation/Neighborhood Parks. The proposed amendment would include provisions for creating neighborhood parks and open space in conjunction with the platting process.


At these hearings, the Bismarck Planning & Zoning Commission will provide an opportunity for all interested persons to be heard with respect to these items. Descriptions of these requests are on file and may be viewed or copied any working day between 8:00 a.m. and 5:00 p.m. at the City-County Community Development Department, 221 North 5th Street, Bismarck, North Dakota.
