Officer Involved Shooting

A 51-year-old man has been charged in connection with an assault on a Bismarck Police Officer that occurred on October 15th.

Donald Miller, 51, has been charged with Robbery, a B Felony, and Simple Assault on a Peace Officer, which is a C Felony.

Regarding the Robbery charge, according to the complaint, “The defendant, in the course of committing a theft, willfully inflicted bodily injury upon another or threatened or menaced another with imminent serious bodily injury; specifically, the defendant, in the course of attempting to steal a police vehicle, inflicted bodily injury upon a Bismarck police officer.”

Miller is currently in a local hospital receiving treatment for a gunshot wound he received during the commission of the crimes. At the time of the incident Miller had a Bismarck address.

Previously Released Information:

On October 15, 2017 at 9:47 a.m., a Bismarck Police Officer arrived at the Bismarck Motor Motel, 2301 East Main Avenue, to do follow-up on an unrelated call. Before the officer could get out of his squad car, he was attacked by the suspect, who punched him in the head repeatedly, and was gouging his eyes.

The officer fought back, and even tried to Tase the subject, which was ineffective. Therefore, the officer shot the suspect in the abdomen to stop the attack.

The suspect, whose identity is unknown at this time, was taken to a local hospital where he is currently in surgery. The officer was also taken to a local hospital where he is being treated for head and serious eye injuries.

The case is under investigation.
